DMCA Notice and Takedown Policy for Vishal’s Place

1. Contact Information for DMCA Notices

If you believe that content available on Vishal’s Place infringes upon your copyrighted work, you may send a written notice containing the following information to the Designated Copyright Agent:

2. Required Elements for a Valid DMCA Notice

Your notice must include the following items (as required by the DMCA, 17 U.S.C. § 512(c)(3)):

1. A physical or electronic signature of the copyright owner or an authorized representative.

2. Identification of the copyrighted work(s) you claim to have been infringed.

3. Clear identification of the infringing material on our site (e.g., URLs or content description).

4. A statement either that you have a good-faith belief that the use of the infringing content is not authorized by you or the law, or that the listed material is not authorized.

5. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.

6. Your name, telephone number, and email address, and your address if sending via mail.

 

3. Response Procedure

Upon receipt of a proper DMCA takedown notice, we will expeditiously remove or disable access to the alleged infringing content.

We will notify the user who posted the material about the claim and may provide them with your notice.

The user may submit a Counter-Notice, and if valid, we will restore the material within 10 business days unless notified by a court.

4. How to Send Counter-Notice

If you believe material you posted was wrongly removed, your counter-notice must include:

Your physical or electronic signature.

Identification of the material removed and its location before removal.

A statement under penalty of perjury that you believe in good faith the material was removed due to misidentification or mistake.

Your name, address, telephone number, and email address, plus consent to the jurisdiction of your relevant federal district court with a statement that you’ll accept service of process there.

We will promptly forward your counter-notice to the complaining party and will restore the material within 10–14 business days unless they provide notice of legal action.

5. Repeat Infringers

Vishal’s Place reserves the right to terminate accounts or access of users who are repeat infringers, as defined under the DMCA and our Terms of Service.

6. Other Legal Remedies

Please note that this DMCA policy is in addition to—and does not waive—any other legal remedies available under Indian law or applicable jurisdiction.
